Abstract
Hadith is the second primary source of Islamic law after the Qur'an, but not all hadiths possess equal authenticity. Weak (dhaif) hadiths remain among the most debated categories, particularly in their application within Islamic jurisprudence (fiqh). This study aims to analyze the position, boundaries, and justification for the use of weak hadiths in fiqh from the perspectives of classical and contemporary scholars. Utilizing a qualitative approach and library research method, this study investigates authoritative works in hadith sciences, Islamic jurisprudence, and legal theory (usul al-fiqh). The findings reveal that most scholars permit the limited use of weak hadiths, primarily in the context of virtuous deeds (fadhail a‘mal), under the condition that they are not excessively weak and are not used to establish determinate rulings such as halal and haram. The study formulates methodological criteria for acceptable use of weak hadiths and proposes the maqashid al-shariah framework as an ethical and practical basis for their application. These findings aim to contribute to a more moderate, contextual, and methodologically sound understanding of Islamic teachings.
